These Terms and Conditions (“Terms”) govern the use of [ExperienceCabo.com] and the reservation services provided by [Experience Cabo], a company legally established in Mexico (“Experience Cabo,” “we,” “our,” or “us”).
By making a reservation or payment, you agree to these Terms.
1. Nature of Services
We act solely as an independent booking agent arranging reservations for tours, excursions, and activities operated by third-party service providers (“Tour Operators”).
We do not operate, control, manage, or supervise the tours unless explicitly stated. Your contract for the actual tour or activity is directly with the Tour Operator.
The Tour Operator is solely responsible for:
• Conducting the activity
• Safety standards and procedures
• Equipment and personnel
• Compliance with applicable laws
• Participant supervision
2. Payments and Currency
• All prices are listed and processed in United States Dollars (USD).
• Payments are processed securely through third-party payment providers, including PayPal.
• By submitting payment, you authorize us to charge the stated deposit amount.
You acknowledge:
• Exchange rates and foreign transaction fees are determined by your financial institution.
• Payment processing is subject to PayPal’s User Agreement and policies.
3. Deposits and Booking Confirmation
• To secure a booking, a deposit is required at the time of reservation.
• A booking is not confirmed until you receive written confirmation from us.
• Remaining balances, if any, may be due directly to the Tour Operator as indicated at booking.
4. Customer Responsibilities
You are responsible for:
• Providing accurate booking information
• Arriving on time at the designated meeting point
• Meeting health, age, and physical requirements
• Following all safety instructions from the Tour Operator
Failure to comply may result in refusal of participation without refund.
5. Assumption of Risk & Liability Waiver
Participation in tours and activities involves inherent risks, including but not limited to:
• Physical injury or illness
• Property damage
• Water, transportation, and outdoor risks
By booking and participating, you voluntarily assume all risks and agree:
• To release, waive, and hold harmless Cabo Experience, its employees, affiliates, and agents from any liability for injury, death, loss, or damages arising from participation.
• To release liability of Tour Operators, acknowledging that we act only as an intermediary.
You further agree that our maximum liability, if any, shall not exceed the amount of the deposit paid.
6. Travel Insurance Recommendation
We strongly recommend purchasing travel insurance that covers:
• Cancellations
• Medical emergencies
• Lost or delayed property
• Other unforeseen events
Travel insurance is the responsibility of the participant and is strongly advised to protect your booking.
7. Force Majeure
We are not liable for failure to perform due to events beyond our control, including but not limited to:
• Natural disasters
• Government restrictions
• Public health emergencies
• Border closures
• Weather conditions
• Transportation interruptions
8. Governing Law & Jurisdiction
These Terms shall be governed by the laws of Mexico.
Any dispute arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of [Your State in Mexico].
9. Entire Agreement
These Terms constitute the entire agreement between you and the Company regarding the use of our Website and services.

Customer-Initiated Cancellations
All cancellation requests must be submitted in writing to Roger@Experiencecabo.com
If a cancellation request is received at least fifteen (15) days before the scheduled tour date:
• You will receive a refund of the amount paid, minus a 10% service and administrative fee.
If a cancellation request is received fewer than fifteen (15) days before the scheduled tour date:
• The booking becomes non-refundable and no refund will be issued.
No-Shows:
• Failure to arrive at the designated meeting location and time is considered a no-show and is non-refundable.
Operator Cancellations
• If the Tour Operator cancels due to weather, safety, operational issues, or other unforeseen circumstances:
• You may be offered rescheduling or
• A full refund of the amount paid (no service fee deduction)
Refund Processing
• Refunds will be processed to the original method of payment.
• Refunds may take 5–10 business days to appear, depending on your financial institution.
• Currency exchange fluctuations and foreign transaction fees are not refundable.
PayPal Compliance:
By completing payment, you acknowledge that you have read and accepted this refund policy. Any chargeback or dispute must first be directed to us. Improper or fraudulent disputes may result in legal action.
Chargebacks and Payment Disputes
By completing payment, you acknowledge:
• The deposit secures a reservation for a specific tour/activity.
• The deposit may be partially or fully non-refundable based on the cancellation terms below.
• You agree not to initiate a chargeback without first contacting us.
Improper or fraudulent chargebacks may result in:
• Recovery actions
• Administrative fees
• Legal proceedings
